1. GENERAL

The following terms and conditions (henceforth: the Terms and Conditions”) are valid between you and Serhiy Chepa – b.less (Reg. No. / ICO 48319520 Bratislava, Slovakia) (henceforth: B.less Store; may be referred to as “us” and “we”) and apply to all use of and orders placed on b-less.store website, and orders made by telephone, e-mail or instagram (henceforth together: the “Website”). Please note that B.less Store does not guarantee that all products presented on the Website are in stock or are available for purchase. B.less Store reserves its right to stop selling a product. Orders can only be placed by persons that are 18 years or older. B.less Store reserves the right to revise the Terms and Conditions at any time. The date of the latest update is found in the final section of the Terms and Conditions. Users are responsible for keeping themselves updated with such changes. Please note that the terms and conditions valid for your order is always the terms and conditions that is in effect as of the time that you have placed your order and not a later version. You should keep a copy of these Terms and Conditions for future reference.

LANGUAGE
The language of the Terms and Conditions is English.

 

2. PRICES

The current price of the Goods and Services, inclusive of VAT, is always specified on the website. The price of the Goods and Services specified on the website on the day the Order is placed is always used to determine the final price of the Goods for the final Customer. The Customer acquires the ownership rights to the delivered goods only after the purchase price for the Goods has been paid in full.The prices and delivery costs shown on the Website include sales tax. The delivery costs are shown in connection with the shipping methods at the checkout stage. 

Prices for our products are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

3. PLACING ORDER

By using the Website and/or placing an order on the Website, by telephone, e-mail or by instagram chat you confirm that you have read the Terms and Conditions and the Privacy Policy, and that you accept them; if you do not accept these Terms and Conditions and Privacy Policy, do not place an order. Please make sure that you have read and understood the Terms and Conditions before you place an order. Before you place your order, you will be given the opportunity to review your selections, the information you have provided, the total price of your order and correct any input errors. Please note that products in your shopping bag are not reserved and may be purchased by other customers until you have placed the order at checkout and received the order confirmation email. If prolonged inactivity causes your connection to the Website to fail, your selection of products may be lost. In such case, you will be required to re-enter your selection of products to the shopping bag.

ORDER CONFIRMATION

After submitting your order, we will send you an order confirmation e-mail with your order number, details of the product you have ordered from us, your payment details and delivery details. Please note that the confirmation e-mail is an acknowledgement that we have received your order and is not an acceptance of the order.

ACCEPTANCE AND SHIPPING CONFIRMATION

Please note that all orders placed by you are subject to availability. Once the order has been processed, a shipping confirmation e-mail will be sent with all relevant information about your order. The shipping confirmation or pick-up notification is our acceptance of your order. Please note that B.less Store does not guarantee that all products presented on the Website are in stock at the time of your order. If a product is unavailable, we will contact you shortly, by phone or by e-mail. If we already have received payment for such product, we will refund you the amount of the purchase.

COLORS

Please note that due to the color settings of your computer, the colors of the products shown in the pictures on the Website can differ somewhat from their actual colors. B.less Store cannot be held responsible for any such discrepancy.

CUSTOM ORDERS OR PERSONALISED ITEMS

Custom orders and personalised items are made to order and cannot be returned or exchanged. Once the order has been sent by the customer and confirmed by B.less Store, the customer will be informed via an order confirmation email. Once the order is processed and accepted, the customer will receive a shipping confirmation email. Custom orders and personalised items may be delivered in a time slot indicated on the site which may be longer than regular delivery slots. Because of the clearly personalized nature of products and the fact that they are produced specifically for the customer, they cannot be returned, refunded or exchanged. Similar, the customer does not have the right to cancel the order.

4. PAYMENTS AND DELIVERY

PAYMENTS 

The following payments are accepted.

Credit cards and debit cards

Payment can be made by the following credit cards: Visa, Mastercard and American Express. Payment can also be made by the following debit cards: Visa and Maestro. (Maestro and Visa Electron: please check with your bank to make sure your card is valid for online purchases). The purchases made with Visa and Mastercard are verified by a secure code. Please note that your card is debited with the purchase amount once B.less Store has sent you the order confirmation email. We do our best to make the Website as secure as possible. All credit/debit card transactions on the Website are processed using Adyen, a secure online payment gateway that encrypts your card details in a secure host environment. Payment will be debited and cleared from your account upon acceptance of your order by B.less Store. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorized by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to B.less Store, your order will be cancelled. We are not responsible for any charges or penalties which may be imposed by the payment provider as result of payment being processed in respect of your order.

DELIVERY
Shipping methods

We offer different shipping methods to meet your needs as further specified when you check out. Dispatch of orders may take up to 5 business days but we aim to dispatch all orders within 24 hours during weekdays, or 1-2 business days during sales periods. Please note that delivery times are provided as guidelines only, and commence from the date of dispatch. The delivery times do not take into account possible delays caused by payment authorization and/or stock availability. If B.less Store fails to deliver within 30 days, you may have the right to cancel the purchase. 

Goods shipped within Europe which are available are normally delivered within 5-15 working days. For shipments to non-European countries, the delivery time depends on the type of shipping (airmail / overland / maritime) and the location of the recipient.

If you order a product that was available in accordance with the article description, and we have not been supplied with this product from our suppliers with no fault of our own, we may withdraw from the contract. In this case, we will inform you immediately and, if applicable, suggest an alternative similar product. If no comparable product is available, or you do not want delivery of a comparable product, we will refund any amounts which have already been paid without delay. The right to withdraw from the contract shall also apply in this case.

We are entitled to make partial shipments and/or services, as far as this does not affect any conflict of interests unreasonably. Should a partial delivery become necessary, we shall, of course, accept the additional shipping costs. No further costs shall arise for you.

The delivery time is extended appropriately if the delivery is affected by a force majeure situation. Force majeure shall be deemed to be, for example, subsequent material procurement difficulties, riot, strike, lockout, malfunction, fire, natural disasters, transportation disruptions, change to the statutory provisions, official measures or regulations or the occurrence of other unforeseeable events, which are beyond our control and which – taking an objective point of view – have not been caused by any culpable conduct on our part. Should one of the above described cases arise, we shall inform you immediately. If this hindrance to performance should last longer than four weeks, you are entitled to withdraw from the contract. In this case, further claims, in particular for damages, do not exist. This does not apply as far as in cases of wilful intent or gross negligence, in case of assurances, or due to breach of essential contractual obligations caused by simple negligence or if compulsory liability applies in foreseeable damage typical for contracts for legal reasons, due to mandatory liability.

6. DEFECTIVE PRODUCTS

If you receive defective products, please notify us immediately and within a reasonable time after you have detected that the products are defective. If B.less Store reasonably determines that the products are in fact defective, B.less Store reserves the right to send you a non-defective identical replacement item and will cover shipping costs for return of defective item.

7. COMMUNICATION

Parties agree that all communication will be held via email. 

The Customer will use for communication the email address of B.less Store stated in this Terms and Conditions 

The seller (B.less store) will send all communication to the email address that was stated by the Customer in the order.

8. SECURITY AND COOKIES

Cookies are used on the site to improve your browsing experience. In addition to use for statistical purposes, cookies identifies your computer and allows the site to recall your personal settings. You browser can be set to send a notification when a cookie is activated. This allows you to deny use of this cookie or to delete the cookie at the end of your visit. The Website cannot be accessed if cookies are disabled. By browsing the Website you consent to the use of cookies.

SECURITY

B.less Store use Secure Socket Layers (SSL), the industry standard in transferring information to process your orders. B.less Store online shop secures communications by encrypting all data to and from the site. 

NO LIABILITY

While B.less Store endeavors to keep your information private, in no event will B.less Store be liable to you for any incidental, consequential, or indirect damages (including, but not limited to, damages for loss of data, loss of programs, cost of procurement of substitute services or service interruptions) arising out of the use of or inability to use the Website, even if B.less Store or its agents or representatives know or have been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, B.less Store liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to B.less Store.

9. CLAIMS RESOLUTION

Arbitration Procedures

You must first present any claim or dispute to B.less Store by contacting us to allow us an opportunity to resolve the dispute. You may request arbitration if your claim or dispute cannot be resolved within 60 days after presenting the claim or dispute to B.less Store. B.less Store  may request arbitration against you at any time after it has notified you of a claim or dispute in accordance with section 27(Notifications).

 Alternative/Online Dispute Resolution

The European Commission has launched an online platform that will allow consumers and traders to settle disputes through an Alternative or Online Dispute Resolution (ADR/ODR). This platform will aid in settling disputes out of court in order to resolve disputes in a less expensive, easier and faster manner. The ODR is operational as of 9 January 2016 and is accessible to consumers and traders under: https://ec.europa.eu/consumers/odr/

Fees and Expenses

All administrative fees and expenses of arbitration will be divided equally between you and B.less Store. Each party will bear the expense of its own counsel, experts, witnesses and preparation and presentation of evidence at the arbitration hearing.

YOU MUST CONTACT B.LESS STORE WITHIN ONE (1) YEAR OF THE DATE OF THE OCCURRENCE OF THE EVENT OR FACTS GIVING RISE TO A DISPUTE, OR YOU WAIVE THE RIGHT TO PURSUE ANY CLAIM BASED UPON SUCH EVENT, FACTS, OR DISPUTE.

10. CLOSING STATEMENTS

INFORMATION ON THE WEBSITE

B.less Store cannot promise that the content of the site is free of inaccuracies or typographical errors. Neither can we guarantee that all information is up-to-date. B.less Store may, at any time, amend the content of the site. Although B.less Store strives to display the correct texts, images and pricing on the site and online shop, errors may occur. Part of the services provided through the site are maintained by third party operators. In situations where B.less Store acts as agent for such services, we cannot be held responsible for any errors resulting from their activities. B.less Store cannot be held responsible for any damage caused from using the site or, for that matter, not being able to use the site. B.less Store cannot guarantee problem-free, uninterrupted, and secure access to the site.

The Website may contain links to other websites beyond our reach. We cannot be held liable for content or privacy policies of such sites.

VIOLATION OF RULES

B.less Store reserves the right to seek all solutions available at law and in equity for violations of these Terms and Conditions, including the right to block access to the site. Individuals violating the restriction of password-protected areas of the site may be subject to prosecution.

RESPONSIBILITY

B.less Store liabilities to you are limited in each separate case to these Terms and Conditions unless otherwise is stipulated by law. In no case whatsoever will B.less Store assume any liability for indirect damages such as loss of profit or in case of force majeure such as war, civil war, revolution, riot, governmental measures, strike, lockout, blockage, failure of electricity, telephone or internet service, natural disasters or similar events. B.less Store liabilities to you will never exceed your total purchase amount for each order. In case of force majeure, B.less Store obligations will be suspended. The contract between you and B.less Store can, in such cases, be partially or fully terminated by yourself or by B.less Store.

PROVISIONS SEVERABILITY

If any part of these Terms and Conditions are held to be invalid or unenforceable, such determination shall not invalidate any other provision of these Terms and Conditions; instead the invalid terms and conditions shall be replaced with other terms in order to give effect to the commercial intentions of these Terms and Conditions.

 GOVERNING LAW

The conditions in this contract shall be governed by and constructed to comply with the EU E-commerce Directive and National Law regulations of  the Slovak Republic. We may change and update these Terms and Conditions at any time without prior notice. For each order, the Terms and Conditions put forth on this site at the time of the order are the ones that apply. Last updated: December 1st 2021.

COMPLETE AGREEMENT

Except as expressly provided in a particular “legal notice” on the site, these terms & conditions, together with the privacy policy, constitute the entire agreement between you and B.less Store with respect to use of the site and content.
